The Beacon Jounal - Nov. 22, 2002

On again, off again. That's how it is in Vermont

The big election news hereabouts may have been Republican victories in five of the six New England governorships. But up in Wilmington, Vt., the big electoral news is that clothes can again come off -- legally -- at nearby Harriman Pond.

Last June, the board of selectmen, prodded by complaints from some among the local citizenry, voted 4-1 in favor of a city ordinance declaring nudity a public nuisance in this town in the southern Green Mountains.

Foes of the ban petitioned for a townwide vote, and, in late August, Wilmington's ordinance was upheld by seven votes, out of almost 600 ballots cast.

This being America, and in particular, at least on this issue, Vermont, the opponents of the ban on nudity petitioned for another vote.

This time, on Election Day 2002, the Wilmington ordinance was defeated by 17 votes, 495 to 478.

One factor was undoubtedly the willingness of a pro-nudist to drop his lawsuit challenging the ban if a majority of the town's voters would be willing to change course.

Lawsuits can be costly to defend, even if you are in the right, and the voters of Wilmington may have felt that they could use their tax money better elsewhere.

Still, Vermont's winter has set in and no sane person would skinny-dip at Harriman Pond even if he or she wanted to.

But come spring, who knows what the law may be?

The scheduled March Town Meeting will provide another opportunity for change -- it takes only 87 residents of Wilmington to petition for another go-round.

Just a quick update!

It is now a year later and everything is quiet. No one has pursued this any further, and we are free to be nude at the "Ledges". We've also been raising public awareness of how much money nudists bring in by stopping at local businesses, buying a coffee and asking for directions, even if we already know where it is.
